These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and RentPilot, Inc. ("RentPilot," "we," "us," or "our") governing your access to and use of the RentPilot property management platform and related services (collectively, the "Service").
By creating an account, accessing, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.
Important: If you do not agree with these Terms, you must not use the Service. Your continued use of the Service after changes to these Terms constitutes acceptance of the modified terms.

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuance of the Service.
Our Service integrates with third-party services (TransUnion, PayScore, Checkr, Stripe, etc.). Your use of these third-party services is subject to their respective terms and conditions. We are not responsible for the performance or availability of third-party services.

We offer different account types (Starter, Professional, Enterprise) with varying features and limitations. Your subscription plan determines your access level and usage limits.
Payments are processed through third-party payment processors (Stripe). By providing payment information, you authorize us to charge your payment method for all fees incurred. You must provide current, complete, and accurate billing information.
Your subscription automatically renews at the end of each billing period unless you cancel before the renewal date. You will be charged the then-current subscription rate. We will notify you of any price changes at least 30 days in advance.
If payment fails, we may suspend your access to the Service until payment is received. We reserve the right to charge late fees or interest on overdue amounts. Continued non-payment may result in account termination.
Fees do not include applicable taxes. You are responsible for all sales, use, value-added, and other taxes except those based on our net income. We will charge applicable taxes if required by law.

The Service, including all content, features, functionality, software, and designs, is owned by RentPilot and protected by U.S. and international copyright, trademark, patent, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.
You retain ownership of content you upload ("Your Content"). By uploading content, you grant us a worldwide, non-exclusive, royalty-free license to use, store, display, reproduce, and distribute Your Content solely to provide the Service. We do not claim ownership of Your Content.
If you provide feedback, suggestions, or ideas about the Service, you grant us unlimited rights to use such feedback without compensation or attribution.
You may cancel your subscription at any time through your account settings or by contacting support. Cancellation takes effect at the end of your current billing period. You will not receive refunds for unused time, except as specified in Section 4.6.

YOU USE THE SERVICE AT YOUR OWN RISK. WE ARE NOT RESPONSIBLE FOR DECISIONS YOU MAKE BASED ON INFORMATION PROVIDED BY THE SERVICE.
Tenant screening reports are provided by third parties (TransUnion, PayScore, Checkr). We do not verify the accuracy of these reports. You are solely responsible for making housing decisions in compliance with applicable laws. Our AI recommendations are advisory only and should not be the sole basis for tenant selection.
The Service does not provide legal, tax, or financial advice. You should consult appropriate professionals for specific advice related to your circumstances.
Limitation of Liability:
TO THE MAXIMUM EXTENT PERMITTED BY LAW, RENTPILOT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

Before filing a claim, you agree to contact us at legal@rentpilot.app to attempt to resolve the dispute informally. We will work in good faith to resolve disputes within 30 days.
If informal resolution fails, any dispute shall be resolved through binding arbitration in accordance with the American Arbitration Association (AAA) rules. Arbitration will be conducted in San Francisco, California, or remotely by videoconference. You and RentPilot agree to waive the right to a jury trial or class action.
Either party may bring a claim in small claims court if it qualifies, instead of arbitration.
You agree to bring claims only in your individual capacity, not as a plaintiff or class member in any class or representative proceeding.
These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any legal action must be brought in the state or federal courts located in San Francisco County, California.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and RentPilot regarding the Service.
If any provision is found unenforceable, the remaining provisions will remain in full effect.
Our failure to enforce any right or provision does not constitute a waiver of that right or provision.
You may not assign or transfer these Terms without our written consent. We may assign these Terms without restriction.
We may modify these Terms at any time. Material changes will be notified via email or in-app notice at least 30 days before taking effect. Your continued use after changes constitutes acceptance.
